These General Terms and Conditions govern all contractual relationships between the enterprise VECA ENTREPRISES, registered in Overijse (3090), Belgium, under the name "Hors du Commun" (hereinafter referred to as "the Supplier"), and any natural or legal person accessing or placing an order on the website https://www.horsducommunofficiel.com (hereinafter referred to as "the Client"). These conditions apply to all current and future commercial transactions concluded via the website, which is hosted on the Shopify Inc. platform, and shall prevail over any other communication, proposal, or representation.

CONTRACTUAL FRAMEWORK AND SCOPE OF APPLICATION

By accessing the website and placing an order, the Client acknowledges having read and accepted these Terms and Conditions in their entirety. Any order implies the Client's full and unreserved acceptance of the provisions stated herein. These Terms may be updated periodically; the version applicable to the Client is the one in force at the time of order confirmation. Any clause considered invalid or unlawful under Belgian law shall not affect the validity of the remaining clauses. Belgian law shall exclusively govern this agreement, and any dispute shall fall under the jurisdiction of the competent courts of the district of Overijse, unless superseded by binding consumer protection regulations.

ORDER PROCESS AND FORMATION OF THE CONTRACT

The Client selects the desired product(s) via the website, adds the item(s) to their cart, and proceeds to the checkout interface. After selecting a delivery method and completing the payment, the order becomes final and binding. The Supplier confirms receipt of the order via email and subsequently notifies the Client when the order is dispatched. The Supplier reserves the right to refuse or cancel any order in cases of suspected fraud, erroneous data, or violation of these Terms. Products remain the property of the Supplier until full payment is received.

PRODUCT CHARACTERISTICS AND LIMITATIONS

The Supplier undertakes to display product descriptions, sizes, and prices with the utmost accuracy. However, the Client accepts minor deviations in dimensions, colors, or textures due to manufacturing tolerances or digital display limitations. The first product release under "Drop 01" is limited in quantity and produced with artisanal care. As a result, the Supplier does not offer returns or exchanges. Once an order is placed and confirmed, it is irrevocable and final, subject only to legal rights of withdrawal explicitly provided under applicable consumer laws within the European Union.

PRICING, PAYMENTS, AND INVOICING

All prices are expressed in euros and include VAT. Shipping fees are not included in the listed price and are calculated and added at checkout according to the delivery destination: €4.99 for shipments within Spain, €8.99 for shipments within Europe, and €29.99 for international shipments. The Supplier does not currently issue VAT invoices; however, the purchase confirmation email shall serve as sufficient proof of the transaction. Accepted payment methods include VISA, Mastercard, American Express, Maestro, Bancontact, PayPal, Apple Pay, and all other secure online systems integrated through Shopify Payments and Mollie. Orders will be processed only after the payment is validated by the Client’s financial institution.

SHIPPING AND DELIVERY

Products are dispatched from the Supplier’s warehouse located in Madrid, Spain (postal code: 28010). Delivery is made to the address specified by the Client at the time of purchase. Estimated delivery times are provided on the product page and may vary depending on logistical circumstances. Should an order be lost in transit or prove undeliverable due to inaccurate address data provided by the Client, the Supplier reserves the right to cancel the order and refund the Client. In such cases, a refund will be processed only after written confirmation and bank details are provided by the Client.

LIMITATION OF LIABILITY

The Supplier shall not be held liable for any direct or indirect damages arising from the use or inability to use the website, including but not limited to service interruptions, data breaches, unauthorized access, or damages caused by third-party links or malware. The Supplier shall not be responsible for typographical errors or inaccuracies in product descriptions that do not affect the essential characteristics of the goods. Liability is strictly limited to the amount paid by the Client for the product concerned.

INTELLECTUAL PROPERTY AND USE RESTRICTIONS

All intellectual and industrial property rights relating to the website content, including but not limited to texts, images, logos, videos, design elements, source code, and software functionalities, are the exclusive property of Hors du Commun and are protected under Belgian and European Union laws. Any reproduction, distribution, or use for commercial purposes is strictly prohibited without prior written consent. The Client may view and store website content only for personal, non-commercial use.

PERSONAL DATA AND PRIVACY COMPLIANCE

The Supplier processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Belgian data protection laws. By placing an order, the Client consents to the collection and use of their personal information for the purpose of order processing, shipping, customer communication, and marketing (where applicable). The Client may exercise their rights of access, rectification, and deletion by contacting info@horsducommunofficiel.com.

AMENDMENTS AND UPDATES

The Supplier reserves the right to modify these Terms and Conditions at any time without prior notice. Such changes will be published on the website and will apply to all subsequent orders. The continued use of the website after the publication of revised Terms constitutes acceptance thereof.

CUSTOMER COMMUNICATION AND FEEDBACK

PROMOTIONS AND GIVEAWAYS

Occasionally, the Supplier may organize promotional giveaways announced via social media. Participation rules will be explicitly stated on the campaign visuals. Typically, participants are required to follow the account, like the post, share it in their stories, and tag one or more friends in the comments. Giveaways will be active for three full weeks unless stated otherwise. Winners will be selected randomly and announced via the Supplier’s official social channels. All shipping and prize costs will be covered by the Supplier. No purchase is required to enter a giveaway.

The Supplier is VECA ENTREPRISES, an individual business entity operating under Belgian law with its registered address in Overijse, 3090, Flanders, Belgium. All services and products are provided from this address or from its operational facilities in Madrid, Spain. The website is hosted and supported by Shopify Inc.
